An aassault is any intentional, unlawful threat to do bodily injury to another by force, under circumstances which create a well-founded fear of imminent peril, coupled with the apparent present ability to carry out the act if not prevented.

A battery is the willful or intentional touching of a person against that person’s will.

Assault and Battery Punishment
Assault and battery is a misdemeanor punishable by imprisonment for not more than 93 days or a fine of not more than $500.00, or both. Depending upon a number of factors, assault and battery can also be charged as misdemeanor domestic violence or aggravated assault.
